little update for any interested:

it was looking quite rosey for a while with the offer of payment, the damage to my car door meant that it needs a new one, repair estimate is over £1000 (uk stirling) sad.gif not the sort of money that my neighbours have lying around for this kind of thing (nor me!) so it just had to go to insurance and let them fight it out!

Strangly though, Sunday morning the phone rang and it was the police asking if they could come round to take a look (2 weeks late but hey!) they arrived, took a good look at my photo`s ( ones at the start of this thread) and agreed that it did look rather likely.

Anyways, yesterday they arrived back, this time to speak with my neighbour (who was out on Sunday) even though the guys parents have agreed from the damage to both cars that he must have hit it (or else they wouldnt have offered to pay as well) "lil Joe" is still denying it to the Police!

So anyways, the PC phones me today to explain that they had seen him etc blah blah, there is evidence that he hit the car and he has his own observations but there is no witness`s to the incident, which makes the case "weak", his report along with the photo`s and statements are being passed to the Crown Prosecution service, they will decide if there is enough evidence to prosecute him (which I doubt they will),

The outcome will go in two directions, if they think they can get a conviction from the evidence then they will prosecute him, in which case all my costs (excess on insurance) will be refunded etc, if they decide not to prosecute then it will just be down to my Insurance company to take it any further to try and recover costs, and as a result I`ll probs be out of pocket.

All in all its been one pain in the backside!

Wow, why are things so complicated...
And my question remains, don't they have insurance on their car?

I mean, I don't really see what the problem is. At least here in Spain every car has to be insured, so that when these things happen, the insurance company of the person who made a mistake driving pays for the damage their car did to others (or even your own damage too, if it's an "all-risk" kind of insurance).

well sort of, my insurance is fully comprehensive so my car is actually going in next Tuesday to be fixed and made good again, thats all fine, but the annoying part is that because of him denying it, its got all messy with the Police coming round etc and initially it will cost me a couple of hundred pounds now (my excess on the policy)

I`ll either lose that altogether if they decide that there isnt enough evidence to prove that he did it or get it back if they prosecute and he loses.

All in all, as I said before it just makes it a little awkward when its your neighbours, we have those kind of weird difficult eye contact moments laugh.gif his mother still says good morning etc to me, but they other day when I came home from work the lad (who hit my car) sat in his car until I went indoors laugh.gif

You should have started poking around in the garden, wash the car - yours not the one he was sitting which would have been wierd - etc etc to see how long he would sit there trying to avoid you.

He acts guilty I'd say, if you was wrongly accusing him he'd be upset and would be barking at you. Right?
