First here is Steve Vai. It's the intro I am speaking of.
Now here is Andy James. It's around 1:52. It's a really short phrase.
I just found this cool and interesting. I own the newest Andy James album as of yesterday and it's so awesome.

yeah, it sounds very similar but it's so short to consider that a plagiarism. I really like Andy's playing, I have his first album and will get his second one soon...

Nice comparison, but the solos often tend to be very similar, and I don't think that this could be plagiarism in the true sense of the term!
It always makes me LOL when I see the fans in a Steve Vai, Andy James, John Petrucci, Yngvie show versus say a metal band like Metallica. Metallica gets a mosh going, whereas the neoclassical fans just stand there staring at the fretboard - the rest of the band could be sleeping and the fans wouldn't know it

All 3 Andy James albums are great, the first 2 albums have some great ballads. He has alot more to offer than just shreding, which is what the first two albums really show.....
But
Really, If you looked hard enough you could find many, many similiar ideas, licks, phrasing, pick attack, articulation of what Andy does compared to Nuno Bettencourt, Yngwie, Satch, Vai etc
This is the beauty of listening to an Original artist like Andy who himself has been influenced by some of my fav guitar players....
This is one of my ultimate fav Andy songs.... not what you are expecting?

So many licks and riffs and solos have been played, I don't believe these guys steal intentional like that. It's a coincidence IMO
