Vai pretty much snagged Paginini's 5th Caprice for the basis of his solo, check out Jason Becker doing the 5th

I learned to play Vai's version and Paginini's ages ago, if you go back and listen-Vai only teases the theme in the begining the whole rest of the solo is not part of the 5th Caprice....Jason B's version is much closer to the real version

What is played before the paganini stuff is some kind of variation over Villa Lobos Study Nº2.
