Vai pretty much snagged Paginini's 5th Caprice for the basis of his solo, check out Jason Becker doing the 5th

I learned to play Vai's version and Paginini's ages ago, if you go back and listen-Vai only teases the theme in the begining the whole rest of the solo is not part of the 5th Caprice....Jason B's version is much closer to the real version
