yes that's right, they banned the American flag t-shirts, in schools , on the Mexican independence day , which they don't really recognize in Mexico

It's a speech v. conduct argument - which has always at the center of almost any and all First Amendment issues.
(the yelling of "fire" in a crowded building debate) The 1st amendment is deep.

Yeah, and like I said, it's complicated ... which makes it fluid.
I wasn't there (in San Jose) so I don't know how aggressive and potentially threatening the wearing of the flag t-shirts was - ?
When 'speech' has been really hateful and threatening - symbols and some conduct count as speech - it has been ruled against - as well as overturned.
There are thousands of library shelves solely dedicated to the 1st Amendment.

*I personally don't get bent out of shape when I see another American burn an American flag - I just think they're juvenile.
But I have witnessed, more than once, an American flag burning in another country. It's scary.

and this the foreigners bring that same violence into our country and we have to cave to support their terrorism
it is almost the opposite end , now we have take our flag down to not incite violence

I think the only 'flag' shirts I own are a Captain America t-shirt and a Rolling Stones Union Jack t-shirt.

As I said, I wasn't at that particular school in San Jose and I have no idea whether or not the american flag shirts were meant to intimidate Mexican Americans on one of their holidays (a holiday which has absolutely zero to do with the USA - Mexico v. France). Could be an over-reaction, or maybe not - ?

As a Jew I generally don't dig seeing Nazis and Aryan Nation guys marching down US streets. It offends me, it scares me and it's meant to be hateful, aggressive and provocative. I'm glad 'most' cities here don't allow it. Freedom of speech - in my opinion - has a limit. Most courts think so too.


*And yes, I have beer opened - it's after 3:00 pm here wink.gif
