There's no copyright on a band name.
In Switzerland, as far as I know, you've got these options: A) Trademark it Create a Company for your Band Both of them are relatively expensive. To prove that you've created a work (song), or used a name first, it's enough to put it in a letter and send it to your self, and keep it closed. The post stamp will be accepted as proof in court (at least in switzerland). But I think that in other countries it works too.
