Its 'illegal' To Burn Cd's To Your Computer |

According to the RIAA, burning legally bought CD's to your computer is illegal and prosecutable. QUOTE Now, in an unusual case in which an Arizona recipient of an RIAA letter has fought back in court rather than write a check to avoid hefty legal fees, the industry is taking its argument against music sharing one step further: In legal documents in its federal case against Jeffrey Howell, a Scottsdale, Ariz., man who kept a collection of about 2,000 music recordings on his personal computer, the industry maintains that it is illegal for someone who has legally purchased a CD to transfer that music into his computer. The industry's lawyer in the case, Ira Schwartz, argues in a brief filed earlier this month that the MP3 files Howell made on his computer from legally bought CDs are "unauthorized copies" of copyrighted recordings. "I couldn't believe it when I read that," says Ray Beckerman, a New York lawyer who represents six clients who have been sued by the RIAA. "The basic principle in the law is that you have to distribute actual physical copies to be guilty of violating copyright. But recently, the industry has been going around saying that even a personal copy on your computer is a violation." RIAA's hard-line position seems clear. Its Web site says: "If you make unauthorized copies of copyrighted music recordings, you're stealing. You're breaking the law and you could be held legally liable for thousands of dollars in damages." Might as well make Mp3 players illegal then. This is nuts. They can't do nothing about and they know it. I don't want to promote piracy or anything - but different kind of audio distribution systems are needed ASAP.

Indeed, I'm not endorsing anything illegal either but the situation seems to be escalating out of their control and they seem increasingly desperate, I think there has got to be a radical overhaul of the current system for the record industry to gain even a small amount of control ever again. That case hinges on the fact that he distributed the songs through filesharing - its quoted a little out of context. RIAA aren;t prosecuting him for actualy making the copies, they mentioned in passing that the copies were illegal (trying to make it seem like a proven principle by mentioning it in passing). So, although they would like to RIAA aren;t actually prosecuting the guy just for making copies. Its a grey area though - in the 70s, fair use was deemed acceptable for recording TV programmes and timeshifting - this seemd to be the same pricnciple if you remove the file sharing part, but it has never been proven in court so could go either way. Regardless, Owen and Ivan make great points - the music industry should wise up and stop preventing people from doing what they want to do for their own convenience (copying and sharing aside) -------------------- Check out my Instructor profile

Well I thought It was legal to make home backups of stuff you buy (CDs , DVD movies etc) that you will be using at home only.. ?!

Might as well make Mp3 players illegal then. This is nuts. that guy needs to get a ipod 60gb then lol he wll end up just like me trying to filllit up but it is impossible haha |
